The Windward Store is owned and operated by Windward Instruments. Use of this site forms the agreement that you understand and agree to be bound by these policies. Any remedy or action is limited to the court, and jurisdiction, of the point of sale (Miami County, Indiana) only. Windward Instruments reserves the right to revise these policies with or without notice. User is responsible for compliance with all applicable laws in the location from which you access this website.

Windward Instruments is committed to your privacy and security. Windward Instruments does not require registration to browse our products, contact us, or to place an order at The Windward Store. We have physical, electronic, and managerial procedures in place to safeguard your information. All customer information is treated as confidential. SHIPPING
All customers with a U. S. street address receive FREE standard or ground shipping. The Windward Store determines the carrier used for each order based upon best cost/service available at the time of shipment. APO/FPO/PUERTO RICO/AK/HI ship via USPS only, and shipping charges will apply. No delivery estimate or guarantee is made on any shipment to a military address.

RETURNED SHIPMENTS: Customer is responsible for all additional shipping and handling charges on returned packages, including return shipping to us, and re-shipment. These charges must be paid in full prior to re-shipment. If original shipment was to a third party, we reserve the right to restrict re-shipments to customer billing address. Upon notification of returned shipment and shipping charges due, payment should be made within 10 days. Windward Instruments is not responsible for the condition of returned shipments, and will not assume any liability.
PAYMENT
We accept all major credit cards, money orders, and personal checks. Payment will be charged/made at the time your order is placed. This applies to all items, whether in stock, or special order. Please check the availability of your item(s), or contact us for an estimate. Delays in shipment are not grounds for dispute, or chargeback. Please refer to our availability policy for details.
AVAILABILITY
Please check product details on the site, or contact us for confirmation of availability of a specific product. Availability provided in the product detail, and/or your receipt is an estimate. Actual shipment may vary due to a variety of circumstances. Delays beyond the estimates provided are not grounds for order cancellation.
RETURN POLICY
If you are dissatisfied with your purchase for any reason, you may return it within 15 days of receipt for a refund subject to the terms below. Some products are excluded from refunds - please see exclusions below.
Return Authorization is required for all returns.
Please contact us within 15 days of receiving your item for a return authorization. Then properly package and insure your return (we are not responsible for shipping loss or damage). Your return must include all original packaging, manuals, etc., and be in resaleable condition. Upon receipt and verification of acceptable condition, a refund will be issued.
Any documentation included with your item from the manufacturer dealing with returns is ONLY applicable to purchases made directly from the manufacturer. Windward Instruments (Windward Store) return policy supercedes any such documentation as prevailing policy.
TERMS: Return shipping charges are customer responsibility. Original shipping charges and an 18% restocking fee (if applicable) will be deducted from your refund. Our descretionary restocking fee is 25% - 50% and may be applied to order returns on excluded items which we agree to accept. Such returns and fee assessment is at our determination. Refunds are issued by credit transaction back to the credit card used for purchase, or company draft at our discretion. Refunds are normally completed in 3-7 business days, however, please allow up to 30 days for processing.
EXCLUSIONS: The following items are covered by warranty for defect, but are not returnable for refund or credit:
(1) Customized, directly engraved, or personalized items (including re-sized). (2) Ocean Clocks products (3) Tidemaster UK watches. (4) ashortwalk products. (5) Accessory items (mounts, sensors, wiring, etc.). (6) Sale, Discounted, and/or volume orders of any size (solely at our discrection). (7) Government, corporate, and institutional orders (except individual gifts). (8) Chelsea Timemaster instruments.
ORDER CANCELLATION
Order cancellation made prior to payment processing will be handled without charge. All other order cancellations are subject to a 5% processing fee, plus our discetionary restocking fee stated in our return policy above.
RETURNED CHECKS
Checks returned to us non-paid for any reason are subject to a $35.00 fee. Customer notification will be sent by email of such occurrence. Replacement funds for the purchase price, plus $35.00 fee, in the form of credit card or money order payment, will be due to Windward Instruments within 3 business days of notification.
WARRANTY
All items are warranted by the manufacturer. While we are always happy to assist if possible, Windward Instruments is in no way responsible for warranty terms, or relationship between customer and manufacturer, unless specified in the warranty itself. To receive warranty service, please follow the instructions as provided with your item.
SALES TAX
Windward Instruments maintains offices in Indiana. We are required by State law to collect sales tax on all items that are sold, or shipped, to a location within Indiana. The current Indiana sales tax rate is 7.00%.

All information provided is without warranty of any kind, expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non infringement.
